portalbromo.com – Pemerintah Kota Probolinggo sepakat menjalin kerja sama dengan Kejaksaan Negeri Kota Probolinggo dalam hal penanganan masalah hukum Bidang Perdata dan Tata Usaha Negara (TUN) yang dinyatakan dalam Penandatanganan Nota Kesepakatan antara Wali Kota Probolinggo Habib Hadi Zainal Abidin dan Kepala Kejaksaan Negeri (Kajari) Hartono di Meeting Room Bromo Park, Rabu (23/3).

Menurut Wali Kota Habib Hadi, dalam dinamika penyelenggaraan pemerintahan di Kota Probolinggo, tak terlepas dari munculnya permasalahan hukum. Momentum ini diharapkan dapat membantu pihaknya untuk memperoleh dukungan seperti bantuan hukum, pelayanan hukum dan tindakan hukum lainnya dari Kejari selaku jaksa pengacara negara, saat berhadapan dengan permasalahan hukum di bidang perdata dan TUN.

“Jadi saya berharap kepada seluruh kepala PD, jangan takut untuk datang dan berkonsultasi. Sehingga kita bisa melaksanakan kebijakan atau program yang telah direncanakan seraya memastikan semuanya berjalan dengan baik,” harapnya.

Tak hanya itu, tambahnya, adanya nota kesepahaman ini diharapkan membawa dampak positif bagi pelayanan masyarakat dan meningkatkan kewibawaan Pemkot sebagai pelayan publik yang profesional.

Sedangkan bagi Kejari, persoalan-persoalan hukum yang dihadapi pemerintah akan memberikan dukungan bagi suksesnya tugas penegakan supremasi hukum yang menjadi komitmen Kejari Kota Probolinggo.

“Tentunya, semoga acara ini menjadi ikhtiar bersama untuk menyatukan tekad dan komitmen yang kuat dari kedua belah pihak, sehingga pelaksanaan di lapangan dapat berlangsung tertib dan lancar, secara administrasi maupun tenis,” tutupnya.

Sementara itu Kajari Kota Probolinggo Hartono menyambut baik kerja sama ini. Pihaknya juga siap bersinergi dengan memberi pertimbangan, pendampingan, dan bantuan hukum kepada Pemkot Probolinggo di bidang perdata dan TUN sesuai kesepakatan.

Ia menyampaikan penandatanganan nota kesepahaman ini merupakan kelanjutan dari kerjasama yang rutin dilakukan setiap tahunnya, mengingat masa berlakunya telah habis di tahun 2021 lalu.

“Nota kesepahaman ini bisa dikatakan juga sebagai kerangka landasan implementasi dan pelaksanaan atas koordinasi yang sinergis, untuk membangun kesiapan dan persiapan bersama bagi upaya preventif khususnya bagi Pemkot Probolinggo yang menghadapi berbagai permasalahan hukum yang terjadi,” ujarnya.

Harapannya, permasalahan-permasalahan hukum tadi akan lebih mudah diatasi, diselesaikan dan dihadapi dengan adanya kerjasama ini. Sehingga apabila di kemudian hari timbul permasalah hukum, bisa diantisipasi dan dapat segera diatasi.

“Jadi tidak berpengaruh ataupun menghambat dalam mewujudkan visi dan misi Wali Kota Probolinggo yang ditetapkan sebagai bentuk kegiatan perintah, baik itu fisik maupun non fisik, ” ucapnya.

Ia menambahkan, dasar hukum dari MoU itu sendiri diatur dalam Pasal 30 ayat 2 UU RI Nomor 11 Tahun 2021 tentang perubahan atas UU Nomor 16 Tahun 2004 tentang Kejaksaan Negeri RI.

Dimana dinyatakan bahwa kejaksaan dengan kuasa khusus, dapat bertindak di dalam maupun di luar pengadilan untuk dan atas nama negara ataupun pemerintahan.

“Tujuannya tak lain adalah untuk menyelamatkan dan memulihkan kekayaan negara, kemudian menegakkan kewibawaan pemerintah dan negara serta memberikan pelayanan hukum kepada masyarakat,” terangnya.

Dengan kewenangan yang dimilikinya, Hartono berharap adanya nota kesepahaman ini membawa implementasi nyata dan baik. Sehingga dari Kota Probolinggo melalui jasa pengacara negara dapat berperan aktif untuk membantu menyelesaikan permasalahan di bidang hukum perdata dan TUN yang dihadapi oleh Pemerintah Kota Probolinggo.

“Yang tak kalah pentingnya saat ini, adalah penertiban dan penyelamatan aset-aset milik Pemkot Probolinggo, BUMN ataupun BUMD yang ada di wilayah Kota Seribu Taman ini. Oleh karena itu, nota kesepahaman ini jangan hanya dianggap agenda seremonial belaka atau bertujuan mencari back up hukum,” tuturnya.

Hartono menyatakan nota kesepahaman ini hendaknya lebih mengedepankan komitmen, kesungguhan tekad dan semangat bersinergi untuk kerjasama di dalam mengemban tugas dan amanah negara. Seperti pendampingan hukum, bantuan hukum, pertimbangan hukum, pendapat hukum, konsumtasi hukum dan tindak hukum lain, dalam bentuk negosiator, mediator, fasilitator. (hum/mr)
