Probolinggo, Portalbromo.com – Pengadilan Negeri kota Probolinggo gelar sidang lapangan terkait gugatan oleh 26 orang yang mengklaim sebagai ahli waris lahan luas yang digunakan pemkot Probolinggo di jalan Basuki Rahmad kota Probolinggo, Jum’at Pagi (6/9).

Pekarangan yang sebagian telah ditempati dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu ( PDM -PTST ) itu menjadi lahan sengketa pasca Dewa Bharata Bagus Handoko beserta 25 saudara lainya melayangkan gugatan ke Pengadilan Negeri kota Probolinggo bulan Mei 2019.

26 bersaudara itu mengklaim lahan seluas 10.440 Meter persegi itu adalah miliknya sebagai ahli waris dari Sari Soekarti dengan dasar Leter C. 131/ Persil 38 /S II yang dikeluarkan tahun 1934 atas nama Sari Soekerti.

Selain para penggugat, tampak hadir di lokasi lahan jalan Basuki rahmad ( depan samsat kota Probolinggo ), mulai dari pihak pengadil yaitu Pengadilan Negeri kota Probolinggo, pihak tergugat 1 Pemkot Probolinggo, tergugat 2 BPN ( Badan Pertanahan Nasional ) kota Probolinggo, hingga kelurahan Mangungharjo sebagai tergugat 3.

Sidang digelar dalam rangka pemufakatan atas batas-batas dari lahan yang disengketakan. Setelah cek lokasi, kedua belah pihak penggugat maupun tergugat sepakat batas-batas dari lahan sengketa adalah, sebelah utara makam, sebelah timur bangunan SMP Namira Shcool, sebelah barat jalan ke arah makam, dan sebelah selatan jalan Basuki Rahmad.

Menjelang sholat Jum’at sidang di tutup dan dilanjutkan tanggal 19 September 2019, dengan agenda mendengarkan keterangan saksi -saksi kedua belah pihak.

Dalam keterangan penggugat melalui kuasa hukumnya Mukhisa menyampaikan, lahan yang kini menjadi tempat berdirinya beberapa bangunan antara lain, Masjid Al Hidayah, TPQ Al Hidayah, kantor PPA, kantor Dekopinda, gudang KPU, dan kantor PDM-PTS ( perijinan ) itu adalah lahan milik mbok Sari Soekarti, dengan dasar Leter C. 131/ Persil 38 /S II, yang kemudian dengan dasar tersebut terbit Sertifikat Hak Pakai No. 28. tahun 1990 seluas 6.550 meter persegi, dan Hak Pakai No. 88 tahun 2016 seluas 3.992 meter persegi oleh kantor BPN kota Probolinggo.

“Selain meninggalkan para ahli waris, almarhuma mbok Sari Soekerti meninggalkan harta warisan berupa tanah sawah yang terletak di desa Mangunharjo yang sekarang menjadi kelurahan Mangunharjo kota Probolinggo yaitu Leter C. 131/ Persil 38 /S II, yang kemudian terbit Sertifikat Hak Pakai No. 28. tahun 1990 seluas 6.550 meter persegi, dan Hak Pakai No. 88 tahun 2016 seluas 3.992 meter persegi oleh kantor BPN kota Probolinggo dengan atas nama pemerintah kota Probolinggo.” Jelasnya.

“Setelah Mbok Sari Soekerti meninggal maka yang menjadi ahli waris adalah penggugat dan para tergugat sebagai pemilik hak pakai, namun kenyataanya lahan itu dikuasai sepenuhnya oleh tergugat, sedangkan almarhuma Mbok Sari Soekarti maupun para ahli waris tidak pernah me jual atau mengalihkan hak kepemilikan tanah sengketa tersebut kepada tergugat maupun orang lain “. Lanjut Kikis.

Kikis juga menyampaikan bahwa hal ini sudah pernah disampaikan ke pemerintah kota Probolinggo, namun hingga saat ini pihaknya belum mendapat jawaban.

“Di tahun 2018 Kami sudah 2 kali mengirim surat somasi kepada pemerintah kota Probolinggo terkait masalah ini, namun tidak pernah mendapat respon hingga kami akhirnya kami melayangkan gugatan” imbunya.

Seakan penguatan, Dewa Bharata Bagus Handoko sala satu ahli waris menyelipkan cerita dimana saat keluarga masih menikmati hasil tani dari lahan tersebut, menurutnya, sebelum terbit sertifikat hak pakai, lahan itu perna disewakan ke pabrik gula Wonolangan sebagai lahan tanam tebu, sehingga penggugat sebagai ahli waris masih menerima hasil jual tebuh melalui kelurahan Jati pada tahun 1980.

“Oleh mbok Sari pernah sawah itu diambilkan kontrak kepada PG ( pabrik gula ) wonolangan Dringu melalui KUD Sidodadi di jalan Mastrip No. 151 Kanigaran Probolinggo untuk ditanami Tebu Rakyat Indonesia ( TRI ), sehingga kami sebagai ahli waris dari mbok Sari Soekarti masih menerima hasil jual tebu dari PG Wonolangan sebesar Rp. 300.000 pada tahun 1980 di kelurahan Jati Probolinggo.” kata Agus.

Sejauh ini belum ada tanggapan dari pihak pemerintah kota Probolinggo, Imanto kepala dinas BPPKAD ( Badan Pendapatan, Pengelolah Keuangan dan Aset Daerah ) kota Probolinggo saat dihubungi tidak memberikan tanggapan. (tim)
