Portalbromo.com – Polres Probolinggo terus dalami kasus jual beli tanah milik (alm.) Moasim warga Kanigaran kota Probolinggo dengan Agus Warga Jl. Cokroaminoto sebagai pembeli.

Aziz Cs. Sebagai ahli waris Moasim merasa tidak pernah menjual tanah milik ayahnya yang meninggal di tahun 2002 atau 18 tahun silam, namun di tahun 2017 sebagian tanah tersebut terbit sertifikat atas nama pemilik baru (red:Agus).

Menduga ada kejanggalan pada Akte Jual Beli (AJB) yang diterbitkan oleh Pejabat Pembuat Akte Tanah (PPAT) Feny Herawati. SH.,Mkn. Aziz cs. Membawa masalah ini ke Polresta Probolinggo beberapa waktu yang lalu.

Sugeng Kanit satu Polresta Probolinggo mengatakan, pemeriksaan terus dilakukan, saat ini sampai pada tahap pemeriksaan para saksi dari pelapor.

“Sudah dilakukan pemeriksaan pada dua saksi, tinggal satu saksi lagi dari pihak pelapor, setelah itu kita akan panggil pihak terlapor” kata Sugeng melalui telepon, Selasa (9/6).

Disinggung kapan pemanggilan di lakukan, Dia menjawab dalam minggu ini. ” Dalam minggu ini mas, kita infokan nanti keteman-teman untuk perkembanganya” jelasnya.

PPAT Feny Herawati beberapa kali dihubungi di nomor ponselnya tidak merespon. Namun saat media ini melakukan Pengumpulan Bahan Keterangan ( PULBAKET), muncul sosok pria sebut saja J, pria yang mengenalkan dirinya sebagi suami dari Feny menitipkan dua secarik kertas yang berisi tulisan tangan.

“Ini dari bu Feny” kata J sambil memberikan lipatan kertas.

Berikut beberapa penggalan pesan yang tertulis.
“Tapi karena ada pengakuan dari pembeli bahwa Moasim masih hidup (seolah2) dan data -data ada walapun direkayasa oleh pihak yang tidak bertanggung jawab maka dibuatkanlah akte jual beli lewat mbak Linda.”

“Foto di mbak Linda berarti Moasim gadungan, dan fatalnya ternyata di balik jual beli ini ada dasar utang piutang antara Supandi (sebagai sala satu ahli waris ) dengan Agus (sebagai pembeli). Jadi intinya PPAT telah ditipu oleh para pihak”.

Di konfirmasi lewat selulernya Agus enggan berkomentar, Namun Ia menyatakan siap jika nanti permasalahan ini sampai di pengadilan.

“Suru lanjut saja mas, saya tidak mu menanggapi, silakan saja kalau mau ke pengadilan ya monggo” jawab Agus melalui sambungan telepon, Selasa (9/6).

Sementara itu Bambang Haryono kepala Badan Pertanahan Nasional (BPN) kota Probolinggo sebagai pemegang wewenang pengawasan, pelakasanaan, atas PPAT di kota setempat mengatakan, bahwa dirinya telah mengetahui permasalahan ini, bahkan sejumlah informasi sudah didapat dari beberapa stafnya.

“Untuk informasi sementara dari sala satu staf bahwa pemberkasan untuk AJB nya (alm.) Moasin dilakukan di luar oleh PPAT” ucap Bambang.

Namun Bambang juga mengatakan bahwa informasi itu tidak bisa dijadikan acuan untuk langkahnya kedepan, menurutnya akan ada tim khusus untuk menyelidiki kebenaran dilapangan.

“Namun informasi dari staf itu tidak bisa saya jadikan acuan, akan ada tim khusus yang akan menggali masalah ini, bagaimana kedepanya status PPAT bersangkutan, akan ditentukan dari hasil penyelidikan dari tim ini” jelas Pria yang tidak lama lagi akan memasuki masa pensiun itu.

“Jika hasil sari tim tadi benar bahwa PPAT telah melakukan pemberkasan diluar, ini bukan lagi kelalaian tapi meninggalkan protokol, sedangkan protokol dalam penerbitan AJB merupakan wajib bagi setiap PPAT” jelasnya.

Kamari SE, Pria yang diketahui sejak awal memberikan pendampingan pada keluarga ahli waris menambahkan, bahwa kasus jual beli tanah antara (alm.) Moasim dengan Agus mulai jelas, menurutnya tinggal menunggu proses hukumnya.

“Tidak ada alasan pihak Polres tidak melanjutkan kasus ini, terlebih sudah ada informasi bahwa PPAT merasa tertipu oleh beberapa pihak terkait kelengkapan berkas, berarti kan sudah jelas” katanya ditemui di rumahnya.

“Dengan demikian, lanjut Kamari, kasus peralihan tanah milik (Alm.) moasim yang diduga penuh dengan pengaturan itu segera dituntaskan.” Pungkas Kamari. (tim)
